The Acceptable Terms of Use should be read in conjunction with our Privacy Policy. These counterparts together form part of our Terms and Conditions and use of the website constitutes an agreement by the user to be bound by these Terms and Conditions.

2. ACCEPTANCE OF TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “your” or “user”or customer or service provider) and CANDY GIRL ENTERPRISES LTD trading under the name and style of ‘STYLZ MAG’ (“STYLZ MAG”, “we”, “us” or “our”), concerning your access to and use of www.stylzmag.com. You agree that by accessing the Site, you have read, understood, and agree to be bound by the terms and conditions and Privacy Policy incorporated. IF YOU DO NOT AGREE WITH ALL OF THESE TOU, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

In these Terms, “you” and “your” refer to the individual or entity that uses the Site, or Services. “We”, “us”, or “our” refer to STYLZ MAG. In addition, in these Terms, unless the context requires otherwise, words in one gender include all genders and words in the singular include the plural and vice-versa.

3. ABOUT STYLZ MAG & SERVICES

CANDY GIRL ENTERPRISES LTD trading under the name and style of ‘STYLZ MAG’, is a corporation carrying on its business services in the United Kingdom. CANDY GIRL ENTERPRISES LTD operates the website www.stylzmag.com. The service we provide on the website is subdivided into three;

(a) Directory Services for makeup artists, barbers, hairstylists, tailors, dermatologists and beauty service providers.

This directory service listings shall be for users who have registered to be listed as service providers on the platform.

Payments are taken on the platform from consumers to pay for appointments and appointment deposits for services booked on the STYLZ MAG marketplace.

As a customer using the service provided on www.stylzmag.com you can search for the above-mentioned service providers in our online directory. You can find hairstylists, tailors, make-up artists (MUA's) and many other fashion hair and beauty service providers in our StylzMag directory. You can see pictures of their work, read reviews, contact them and book services using the StylzMag booking system where possible.

The Service providers on the platform promote and manage their services in the manner set forth under these terms and conditions. They are in no way in employment with Candy Girl Enterprises Ltd. We only provide the platform to facilitate a transaction between Service providers and Buyers and as such we have no direct control on terms applicable to the provision of service between the Service providers and the Buyers.

In some instances we provide complimentary directory services to service providers using publicly available information. These services providers did not sign up voluntarily and are unclaimed listings. They are not bound to terms and conditions until they actively use our services. Such service providers do not have access to appointment booking functions and marketplace functions so cannot take any form of payment through the StylzMag platform.

(b) MULTI- VENDOR MARKETPLACE

We also offer on the platform a multi – vendor marketplace and payments are taken on the platform from consumers to pay for goods and postage for items sold on the STYLZ MAG marketplace.

The StylzMag Marketplace provides a venue for vendors to list their various products, and for customers to buy the listed items. STYLZ MAG does not pre-screen sellers or their content. Consequently, STYLZ MAG has no control over, and you agree that STYLZ MAG is not responsible or liable for, any of the following:

The quality, safety, morality or legality of any aspect of the items listed.
The truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items.
The true identity, age, nationality, or sense of humour of a user.
Any content posted by users.

You are encouraged to use the features and functions available to communicate with other users and/or to find out more about an item that a user has put up for sale.

While STYLZ MAG endeavours to keep the Services safe for everyone, your use of the Services and your interactions with other users is entirely at your own risk.

4. AMENDMENTS TO TERMS

STYLZ MAG may revise these Acceptable Terms of Use at any time and update this information. You should therefore verify this page regularly and review the full Terms and Conditions. Your continued use of the website constitutes your agreement to the Acceptable Terms of Use as amended.

5. INTERPRETATION

Unless the context otherwise requires, references to the singular include the plural and references to the masculine include the feminine, and vice versa.

The headings contained in these Acceptable Terms of Use are for convenience only and do not affect their interpretation.

References to any statute or statutory provision shall, unless the context otherwise requires, be construed as a reference to that statute or provision as from time to time amended, consolidated, modified, extended, re-enacted or replaced.

6. GENERAL TERMS

The information and services available on STYLZ MAG website are provided for the purpose of assisting those with an interest in using and / or purchasing services from us. Users must not use the website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website, or any of the areas of, the website.

You must not use the website:

(a) in any way that is unlawful, illegal, fraudulent or harmful; or

(b) in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

All rights not expressly granted in these Acceptable Terms of Use are reserved by us and our licensors.

You are not permitted to decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivative works from the site or the content. The use of network monitoring or discovery software to determine the site architecture, or information about its usage or identify individual users is strictly prohibited.

7. UNLAWFUL AND ILLEGAL MATERIAL

You must not use the website to store, host, copy, distribute, display, publish, transmit or send content that is illegal or unlawful, or that will or may infringe a third party's legal rights, or that could give rise to legal action whether against you, us, or a third party.

You will be required to sign up for a membership to get to use the services that we provide for you. Some of the services we render are free to use, while others would require a subscription package.

Silver directory membership packages allow service providers to have a profile page with general service information, images, user messaging and appointment scheduling services.

a rolling monthly contract billable at £6.99
an annual membership plan with a one-off payment of £69.99

We charge a 4.5% fee for appointment deposits and payments + £0.50 per payment via STYLZ MAG.

Gold directory membership

Gold directory membership packages allow service providers to have a profile page with general service information, images, user messaging, appointment scheduling services and unlimited marketplace store listings.

You can opt for:

a rolling monthly contract billable at £8.99
an annual membership plan with a one-off payment of £89.99

We charge a 4.5% fee for + £0.50 per payment for sales and appointment deposits via STYLZ MAG.

9. SIGNING UP

When you sign up, your username and password will be chosen by you. You are responsible for all actions taken under your chosen username and password.

By creating an account on the Site, you warrant:

- That all the details you provide are true, accurate, current and complete in all respects;

- To only create one (1) account and to only use the Site using your own username and password;

- Not to disclose your password to anyone and to make every effort to keep your password safe;

- Not to suggest, imply or instruct other service users to pay for products and services through other platforms;

- StylzMag to edit grammatical errors and delete low quality or offensive images on profiles and product listings

- To change your password immediately upon discovering that your account has been compromised; and

- To notify us if you suspect someone has accessed your account without permission.

STYLZ MAG reserve the right to terminate your account and to suspend or terminate your access to the website immediately and without notice to you if:

- You breach these Terms;

- You are impersonating any other person or entity;

When requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity; and/or

STYLZ MAG suspect you have engaged, or are about to engage, or have in any way been involved, in fraudulent or illegal activity in relation.

10. RECEIVING PAYMENTS

StylzMag partners with Stripe for secure payments.
We use Stripe to make sure you get paid on time and to keep your personal bank and details secure.

Stripe provides Connect Platforms with the ability to use Stripe Connect to facilitate payments to vendors who have provided goods or services.

You are not a Stripe customer, and the Connected Account Agreement does not apply to you, if you are receiving payment from a Connect Platform (StylzMag) for providing goods or services. Stripe will facilitate the transfer of funds to you based on instructions given to Stripe by the Connect Platform (StylzMag).

After registration, you will need to set up and verify your free Stripe Connect account for receiving payments. You can start this process from your seller dashboard.
On some occasions, you may need to submit identification documentation to verify your account.

11. ACCEPTABLE FORMS OF PAYMENT

We accept the following forms of payment for our services via Stripe payment gateway;

American Express
Discover

You agree to promptly update account and payment information, including email address, billing/mailing address, payment method, and payment card expiration date so that we can complete your transactions and contact you as needed. We bill you through an online billing account for purchases made via the Site. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in GBP.

You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorise us to charge your chosen payment provider for any such amounts upon making your purchase. If your purchase is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to change pricing as set forth on the site.

12. DATA MINING

You must not conduct any systematic or automated data collection activities including, without limitation, scraping, data mining, data extraction and data harvesting.

13. GRAPHIC MATERIAL

You are not permitted to use our website or servers for the propagation, distribution, housing, processing, storing or otherwise handling in any way lewd, obscene, or pornographic material, or other material which we deem to be objectionable, to be determined at our sole discretion.

14. HARMFUL SOFTWARE

You must not use the website to promote or distribute any viruses, Trojans, worms, rootkits, spyware, adware or any other harmful software, programs, routines, applications or technologies.

You must not use the website to promote or distribute any software, programs, routines, applications or technologies that will or may negatively affect the performance of a user’s device.

You are strongly advised to ensure that your own anti-virus and protective software is up-to-date and effective at all times.

15. MARKETING AND SPAM

Users are not permitted to post advertising and/or promotional content that is inconsistent with the purpose of the website. You must not solicit any users of this website to market any products or services except as permitted under our Terms and Conditions. Any content you submit must not constitute spam.

16. GAMBLING

You must not use the website for any purpose related to gambling, gaming, betting, lotteries, sweepstakes, prize competitions or any gambling-related activity.

17. HYPERLINKS

The website may contain links to other sites, which are not under the control of STYLZ MAG. We accept no responsibility or liability for the content, security, availability and privacy practices, or any material on any website that is not under the control of STYLZ MAG. A link to a third-party website does not imply endorsement by STYLZ MAG.

18. UPTIME

STYLZ MAG will endeavour to make the website available to users but cannot guarantee that the website will operate continuously or without interruption. There may be times when certain features, parts or content of the site, or the entire website, become unavailable, or are modified, suspended or withdrawn by us at our sole discretion, without any notice given. We will not be liable whatsoever for any unavailability issues.

We cannot guarantee the speed with which you will be able to access and use the website as it will depend upon factors such as the specification of your equipment and the number of people using the site.

19. INTELLECTUAL PROPERTY

STYLZ MAG is the owner and/or authorised copyright license holder of the logos, trademarks and content present which includes, but is not limited to, the design, layout, look, appearance and graphics. We do not grant any license, copyright or use of any other of our intellectual property rights to you or any third party.

You acknowledge that you do not own and shall not acquire any title, copyright or any other intellectual property rights in relation to the website and you shall not modify, translate, adapt or otherwise amend the contents.

No part of this website content may be reproduced and reused for any commercial purpose whatsoever.

20. DATA PROTECTION

The use of personal information supplied to us by you and other users of this website is governed by our Privacy Policy. We keep all data in our secured systems. Personal data will only be given to third parties when we have a lawful basis to do so.

Any review/testimonial or quote used on the website or other marketing material will only be used when specific and informed consent has been given.

Under Data Protection legislation all individuals have the right to access their personal data and when processing data on your behalf we will comply with the provisions of the General Data Protection Regulation (GDPR), Data Protection Act and other relevant and applicable legislation as in force.

22. DISCLAIMER

STYLZ MAG has taken every care in the preparation of the content on this website, but to the full extent permissible by law, we shall not be held liable for any loss or damage of any nature. We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control. We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill. We will not be liable to you in respect of any loss or corruption of any data, database or software. We will not be liable to you in respect of any special, indirect or consequential loss or damage.

STYLZ MAG will not be liable to users or any third party for any damages whatsoever, whether direct, indirect, incidental or consequential relating to or arising out of a visitor’s use of this website.

23. NO WAIVER

No failure or delay by STYLZ MAG in exercising any of its rights shall be deemed to be a waiver of that right, and no waiver of a breach of any provision of the Acceptable Terms of Use shall be deemed to be a waiver of any subsequent breach of the same or any other provision.

24. MONITORING

We do not actively monitor every interaction on this website and you should always exercise caution in giving personal data. If you become aware of any material on the website that contravenes these Acceptable Terms of Use, please notify us by email to [email protected].

25. SEVERABILITY

If a provision of these Acceptable Terms of Use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
